Summary The Dutch Council of State has agreed to hear an appeal against renewing a permit to the Energy Research Foundation (ERF) of the Netherlands for oceanic Dumping of low-level radioactive waste of Dutch, Belgian and Swiss origin. The proposed dumping operation would, according to the ERF, be conducted according to the provisions of the London Dumping convention (LDC). The suitability of the present dumpsite, and the safety of the entire dumping program, has been evaluated by the Nuclear Energy Association (NEA) of the Organization for Economic Cooperation and Development (OECD). The NEA has concluded, in its 100 page technical report (the "hazard analysis"), that the dumping operation would present no danger to the marine environment nor to the human beings that depend upon it. The present report is a scientific appraisal of the NEA hazard analysis. Relevant new data from surveys of U.S. oceanic radioactive dumpsites are first reviewed, and the resultant conclusions used in the assessment of the proposed European dumping plan. It is shown that the NEA hazard analysis is characterized by six fundamental flaws.
