I Introduction

In 1996 an Intergovernmental Conference of the Member States of the European
Union will take place with the task of deciding on a revision of the treaties
that are the legal bases of the European Union.

The European Parliament in its "Resolution of 16 January 1992 on the Integration
of the ECSC and Euratom Treaties into the EEC Treaty" (2) had demanded a
reform of the legal foundations of EC energy policy. This resolution called for an
integration of the ECSC and the Euratom Treaties into the EEC Treaty (3) , and
increased influence upon legislative decision making. The European Parliament
expected this to be ratified no later than the Intergovernmental Conference planned
for 1996. As the resolution did not influence the Maastricht Treaty, the issue will
consequently come up in the run-up to the Intergovernmental Conference in 1996.

The demands formulated by the Parliament in its 1992 resolution are based in large
part on the findings of the study "Revision of the European Treaties in the Energy
Sector" (4) performed in 1991 by the Öko-Institut for the European Parliament,
Directorate-General for Research.

The present report substantially revises and updates the 1991 study. The
amendments to the ECSC, Euratom and EC Treaties through the Maastricht Treaty
are covered as well as recent developments in the energy policy of the European
Union. Due to these developments a slight change of the wording of the 1991
proposal became necessary. However the concept of the proposal has remained
the same and hopefully will have some impact on the negotiations of the
Intergovernmental Conference in 1996.
