1. SUMMARY This paper is an appraisal of the environmental legal and policy aspects of recent drafts of the European Energy Charter and the Basic Protocol to the Charter. In summary, the Charter is inconsistent with international treaties and declarations concerning the environment. In particular the legality of the European Community signing the Charter is questionable.
