Introduction

1. The motion for a resolution (Doc. 2-1250/84) tabled by Ms TONGUE on
December 1984 forms the basis on which this report makes its conclusions. The 
motion, inter alia, pointed out that the United Kingdom has certain obligations as 
a Member of the European Atomic Energy Community embodied in the 1957 
EURATOM Treaty; and that the United Kingdom is a signatory to the 1968 Nuclear 
Non-Proliferation Treaty (NPT) under which it also has obligations, and that in regard 
to the application of nuclear safeguards at the Magnox reprocessing line at British 
Nuclear Fuels plc facility at Sellafield the reprocessing activity has apparently been 
carried out in contravention of the EURATOM Treaty Article 81 since United 
Kingdom accession on 1 January 1973. The motion calls on the European Parliament 
to endorse its appeal to the United Kingdom Government, the European Commission 
and the International Atomic Energy Agency (IAEA) to resolve the impasse and for 
the Council and Commission to state what steps they intend to take to enforce the 
provisions of the EURATOM Treaty.

2. The motion for a resolution became the subject of an analysis by the legal service
of the Parliament in July 1985(1) and of an opinion by the Committee on Legal 
Affairs and Citizens' Rights in December 1985. (2) Both concluded there was a case 
to answer by the United Kingdom Government and the Commission.

3. In order that the issue of dual compliance with the abovementioned treaties may
be properly understood, this report briefly sets out the context of United Kingdom 
governmental attitudes to first the NPT and then the EURATOM Treaty, before 
assessing the specific issue of the report.
