I. Introduction

1. Renunciation of nuclear energy would involve economic challenges such as:
- offsetting the lost energy supply by the promotion of other, more costly sources
of energy (coal),
- intensive exploitation of other sources of energy and, not least,
- bans on 'nuclear' power imports, which might be the political outcome of such
a decision.

2. Legal problems would arise in meeting these challenges as:
- import restrictions would be irreconcilable with the basic principles of
the common market within the European Community;
- massive and sustained support for the higher-cost national coal industry in the
form of state aid or the like, linked with the renunciation or ban on the import
of nuclear power, would not accord with practice in the common market.

3. These possibilities in the event of the renunciation of nuclear energy call for
an initial general investigation of the viability of such measures within the legal
structure of the EEC Treaties. Articles 30, 36, 92(3), and 93(2), subparagraph 3,
of the EEC Treaty and Article 95 of the ECSC Treaty would be the most important
provisions here.
