The story in brief

No provision has been made for any forum or process to properly consider or better 
understand the concerns of traditional owners regarding Jabiluka. In fact traditional 
owners have experienced great difficulty in receiving any recognition as traditional 
owners in any process associated with the Jabiluka proposal.

It is not clear that ERA has the right to mine and this is currently under challenge 
in the Federal Court.

ERA had to go back to the government for consent yet the people most directly 
affected, traditional owners, are ignored. The proposal put forward by ERA is a new 
one and the Federal government has a responsibility to trigger the national interest 
provisions of the Aboriginal Land Rights Act and allow a proper debate of the issues.

ERA is now using provisions of the 1982 Agreement, secured under duress, to 
attempt to inflict further pressures on our community about the Jabiluka proposal.

Senator Hill has rejected departmental advice that mining provisions of the Aboriginal
Land Rights Act be triggered requiring consideration of the project as a new mining 
interest, however, he invoked the provision of the environmental protection 
legislation to consider the new proposal.

Senator Parer has publicly indicated that he does not believe it necessary to 
undertake an EIS contrary to the recommendation made by the Supervising
Scientist that a new EIS is required and contrary to Environment Minister 
Hill's advice.

The governments own Social Impact Study acknowledges mining hasn't improved 
conditions for the Aboriginal community.

If final approval is given for the project the result will be culturally devastating 
for this community and will continue to undermine the cultural values of the 
World Heritage listing of Kakadu National Park.

The Mirrar wish to make dear they will not tolerate interference with a sacred site 
as described in the new EIS prepared by ERA and they will not participate in any 
forum or process which recognises an unconscionable agreement, fails to act to 
protect country, and compromises the interests of traditional owners.
