Foreword

On 21 February 1990, the Board of Governors of the International Atomic Energy
Agency (IAEA) established a Standing Committee on Liability for Nuclear Damage 
(SCNL ). This Committee had the mandate to consider international liability and 
compensation arrangements for nuclear damage and to prepare for a conference 
to revise the 1963 Vienna Convention on Civil Liability for Nuclear Damage 
(hereinafter referred to as the "Vienna Convention").

The Standing Committee completed its work in April 1997, producing a draft 
Protocol to amend the Vienna Convention and a draft Convention on Supplementary 
Funding for compensation of nuclear damage. In June 1997, the IAEA Board of 
Governors authorized a Diplomatic Conference to consider and adopt the draft 
Protocol and draft Convention on Supplementary Funding. The Protocol to amend 
the Vienna Convention (1) and the Convention on Supplementary Compensation 
for Nuclear Damage (2) were adopted at a Diplomatic Conference held 8 to 
12 September 1997.

The Protocol and the Convention on Supplementary Compensation are intended 
to consolidate recent developments in the field of nuclear liability. In particular, 
the two documents seek to modernize the existing regime and provide for higher 
standards of compensation for nuclear damage. 

This paper compares the provisions of the original Vienna Convention with the 
changes which would be introduced by the Protocol. It also considers the provisions 
of the Convention on Supplementary Compensation. The "package" as a whole is 
measured against the criteria for an adequate and equitable liability and 
compensation regime, identified by Greenpeace at the outset of the negotiations.
